Terms and Conditions
In accordance with the relevant legal provisions contained in the Peruvian Law, Regulations, Decrees and other legal provisions applicable in the national territory, are issued these general conditions and liability below, which will regulate the provision of services, on the one hand between the passenger or user of the services hereinafter referred to as “THE CLIENT”, on the other hand the travel agency which will be referred to as “NOVOTOUR”, and on the other hand the service providers such as airlines, hotels, restaurants, transporters, guides and guides and other service providers, such as airlines, hotels, restaurants, transporters and guides, on the other hand the travel agency to be called “NOVOTOUR”, and on the other hand the service providers, such as airlines, hotels, restaurants, carriers, guides and other services related to tourism and that are related to this contract, hereinafter referred to as “SUPPLIERS”.
NOVOTOUR, whose business activities are carried out as a travel agency through the subcontracting of independent suppliers, who are not subject to the control of the company, especially in transport services, helicopter flights, hotel accommodation, hot springs & SPA, restaurants, cruises, professional guides, car rental, etc… NOVOTOUR CUSTOMERS have the right to receive accurate and timely information, as well as the duty of the CUSTOMER to be informed in a responsible manner with respect to the rules and conditions of services provided by NOVOTOUR.
These Terms and Conditions are understood to be known and accepted by the sole fact of explicit acceptance of these at the time of payment. Any acceptance of an offer made will be subject to the suspensive condition that NOVOTOUR validates the transaction, after verifying that there is availability of air and/or ground space and that it validates and accepts the means of payment offered by the user. Consequently, any transaction that is made, confirmation, validation or verification by NOVOTOUR, will be a requirement for the completion of the contract.
PURCHASE PROCESS: Our prices include taxes and service charges. Offers subject to stock of 05 quotas per destination for flights, hotels, packages, cruises and tours. To make a purchase or contract a service, the process begins with a reservation request generated by the user or consumer from the website or direct attention with our executives and the different promotional channels. The user will receive an email informing them that their request has been received and that their reservation request and the respective payment is being processed after the validation or confirmation process. The confirmation of purchase, depending on the total payment of the service fee and the availability of the service at the time of payment, will be informed by this same means.
RIGHT OF WITHDRAWAL: For purchases made by electronic means or remote communication. The mere visit to the website on which access to certain services is offered does not impose any obligation on the consumer, unless he/she has unequivocally accepted the conditions offered by the supplier, in the manner indicated in these terms and conditions.
MEANS OF PAYMENT: The services offered can only be paid with the official legal means granted by the company legally in Peru or provided that they maintain a valid contract for such purposes with NOVOTOUR, unless a different form is indicated for particular cases by written authorization of the Representative of NOVOTOUR may accept payments to different accounts. In this case the final confirmation will be sent within 24 hours to the email address entered by the customer during the purchase process. If you have not received the confirmation within this period, please contact the Executive that attends you or the corporate email info@novotourperu.com. Interest, taxes, commissions or other charges that may be generated by credit card purchases in instalments depend on the conditions that the customer has agreed with each bank or card issuer. We recommend that you inform yourself of the conditions of use and interest rates of your credit card before using this method of purchase in instalments. If the purchaser of the service is not one of the passengers and the purchase is made with a credit or debit card, for security reasons further information will be requested before confirming the purchase. For your security NOVOTOUR may limit the maximum number of purchases a customer can make during the same day. NOVOTOUR reserves the right to modify any information contained in this website, including those related to services, prices, availability of spaces and conditions, at any time and without prior notice.
SERVICES: The services offered are non-exchangeable and non-refundable by the supplier(s). However, any total or partial refund made voluntarily by the supplier(s), for services that have not been used, will be given to the client after deducting the penalties imposed by the supplier(s). Promotional airline ticket fares do not allow for ticket changes, therefore, the ticket is non-refundable. Meals as indicated in the itinerary: alcoholic and non-alcoholic beverages are generally NOT included. Tours or excursions, our commitment is to respect as much as possible the tour visits mentioned in the descriptions and confirmations. However, there are certain circumstances beyond our control (e.g. venue closes to cater for a large distributor, cleaning, inspection, weather conditions etc.) which may force us to modify the order of the wine tours to be visited. The programmes offered include physical activities, carried out outdoors in contact with nature, as well as excursions and visits to high altitudes, which may involve a risk depending on various factors and circumstances over which the organiser has no direct control. Therefore, NOVOTOUR assumes no liability (including monetary) in case of incident (even of a fatal nature) or illness and any other problem that may occur due to acts or omissions of the SUPPLIERS; due to irresponsible acts of the CLIENTS; for reasons of any other nature (for example: poisoning, strikes, storms, etc.) or due to force majeure events over which there is no direct control.
CANCELLATIONS AND PENALTIES: The penalties for change of dates in economy fares may vary according to the airlines and route, additionally there may be differences in fares to be paid for air ticketing/accommodation/tour, associated with the required change. There are fares that do not allow date changes or refunds due to airline, hotel, tour and transport arrangements. Modification of Itinerary or Excursions: Any requested modification to your trip or experience already confirmed, will have a surcharge of USD 100, plus any additional costs related to the change.
RESERVATION CONDITIONS: The reservation of any tourist programme must be made for the amount established according to the promotion purchased, without prejudice to the modifications that the initial values may experience due to the conditions of the SUPPLIERS, therefore, the value of the reservation amount is non-refundable. The balance payment will be explicitly stated in this contract on the 2 initial pages, which will depend on the promotion purchased, which should not normally exceed 30 days after the date of contracting, with some exceptions. If the programme is a promotion purchased on credit, it must be paid on the dates of commitment agreed with the executive, in case of default for failure to pay the established installments will be grounds for cancellation of the contract.
NOT INCLUDED IN THE STATED TOUR PRICE: Passport fees (if required) for international flights; excess baggage charges; travel insurance; airfare; airport departure and arrival taxes; meals not mentioned in the itinerary; sightseeing and activities mentioned as optional; modification requested after purchase of the tour; personal expenses such as laundry and telephone charges; and anything not mentioned in the program section of the price. NOVOTOUR programs do not include any type of personal travel insurance. It is highly recommended that the client takes out an insurance policy in the country of origin at the time of booking, covering expenses arising from cancellation, accident, illness, repatriation expenses, loss of luggage, etc. For elderly passengers, or those with special health conditions, we suggest a medical check-up prior to the start of the trip, indicating the possibility or not of taking the trip.
CLASSIFICATION OF PASSENGERS: There are three types of passengers: Adults, children or infants. The age range for the definition of each one will depend on the policy established by each of the services (airline, hotel, excursion, transfers, cruises and other services). And may differ between services. It is necessary to consider the age of minors when departing and entering the country visited: it is important to check the age of the minors during the trip, according to the category defined by the ground operators and airlines; this will avoid possible costs due to fare differences in case of changes in the categorization of minors during the trip. Minors must be of the age informed by the client at the time of returning from the trip.
DOCUMENTATION: It is the duty of those traveling to be informed about the necessary documentation for the trip. Find out in advance if you need a passport, visa, vaccinations or other requirements both for the destination and for the countries where your flight makes a stopover. All passengers (adults, children and infants) must keep valid, during the entire duration of the trip (round trip), in perfect condition and with more than six months prior to expiration, the necessary documents for the trip: 1) Identity Card, 2) Passport, for the countries where it is required. 3) Visa, if required, for countries in transit and destination countries. It is the passenger’s responsibility to consult the respective embassy or consulate, either of the country in transit or the country of destination, about the requirements and special conditions of entry at the time scheduled for the trip. Passengers must stay a maximum of 90 days in the destination visited. Only those with work or study visas will be able to extend their stay. NOVOTOUR is not responsible for the loss of any of the required documents or the omission by the CLIENT of any of the above mentioned requirements. Passenger information may be stored in our database. Remember that the passenger’s name must match on the air ticket with the first name registered in your travel document, if this condition is not met, the airlines reserve the right to deny boarding of that person. NOVOTOUR has the right to photograph, film or record any tour or part of it and use the resulting photographs, videos or filming for promotional purposes, for which it will be understood that the CLIENT gives his authorization, unless the client expresses his disagreement at the time of contracting services.
TRAVEL WITH MINORS: 1) Notarial or Judicial Authorization to leave the country in case of traveling with only one of their parents or a third party (in addition, notarial authorization for the third party to represent him/her before public or private organizations abroad). 2) Death certificate in case one of the parents is deceased and the children are traveling with the other parent. 3) Birth certificate. 4) Family record book. All the indicated documents in original and three photocopies. The same applies for national trips including Rapa Nui. UNACCOMPANIED MINOR SERVICE – this service is not sold at NOVOTOUR.
SPECIAL NEEDS – These services are not sold on the NOVOTOUR website, however passengers with special needs must purchase their airline ticket with NOVOTOUR Executives, the services are requested directly from the airline and often involve additional costs. NOVOTOUR is not responsible for bad practices of third parties when providing assistance or logistical support. Any special needs must be requested in a timely manner to the Executive at the beginning of the contracting process.
MINIMUM TIME OF PRESENTATION AT AIRPORT: 3 hours before departure for domestic flights. 5 hours before departure for international flights. In high season and connecting flights, airport check-in times may increase due to demand and terminal change, so it is recommended to be at the airport 3 hours before for domestic flights and 5 hours before for international flights.
LUGGAGE: Find out about the conditions and amount of kilos allowed in checked baggage and carry-on baggage of each airline. NOVOTOUR is not responsible for the deterioration and/or loss and/or theft and/or robbery and/or loss of luggage and other personal effects of the passengers, either by services contracted through the intermediation of the company or taken individually by the passenger. We recommend that you take out travel insurance to cover part of the risks mentioned above. The luggage included in the air tickets are those offered at the promotional value of the programs, you should consult the luggage included in your promotion.
TAXES AND CODESHARES: In some cases, due to strategic alliances of airlines, they may fly routes in collaboration with other airlines, which could mean not boarding the airline with which the initial ticket was issued. Check your ticket to see which airline operates each flight segment in order to avoid possible missed flights. Taxes are in addition to the airline’s published fares and are included in the final charge. Governments and/or local airport authorities may impose and collect additional taxes at the airport. There are countries where departure taxes and/or fees can only be paid in local currency and in cash at the airport therefore NOVOTOUR does not include or is not responsible for these additional taxes.
CHANGES AND REFUNDS: Air tickets/hotels and excursions do not allow refunds. They are non-refundable, non-cancellable and non-endorsable. All possible changes and refunds are subject to the policies of the airline, hotel, excursion or any other additional service provider, if it allows it, it can be done without any cost as long as it allows it, or otherwise it is informed that it may charge penalties for changes and refunds and even charge a difference in those cases in which the purchased fare is no longer available. Additionally NOVOTOUR will not be responsible for the non-fulfillment, delay and/or cancellation of the service, as a result of an act of God, including but not limited to, pandemics, civil disturbances or industrial disputes, strikes, acts of governmental authority, climatic phenomena, security reasons, acts of war and terrorist attacks of any nature, occurred in the countries involved in the contracted ticket. If the program was paid by credit card or other bank card, the client must continue to pay the agreed installments and in the event that charges have been made, no refund will be made. When booking a stay at an establishment, you accept its cancellation and NO SHOW policies, as well as other additional restrictions of the hotel. General cancellation conditions are available on the property’s website and in the NOVOTOUR checkout process, these are displayed at the time of booking. Check the details of each room to see the conditions before making the purchase.
CANCELLATIONS, FLIGHT DELAY AND DENIED BOARDING: The airlines could unilaterally and without prior information to the travel agency: cancellations, rescheduling, flight delays and denied boarding. These situations are beyond any action or knowledge of NOVOTOUR and therefore NOVOTOUR is not responsible for these eventual changes.
SEAT ASSIGNMENT: The published fares do not support seat assignment. If the reservation you are making wants to reserve seats, you must do it directly with the airline or with the support of NOVOTOUR Executives, which will incur an additional cost or you may be randomly assigned seats at no cost at the time of check-in.
ROUTE CHANGES: Are not allowed by the airlines, unless the airline allows it under its policies and conditions.
NAME CHANGES: Are not allowed by the airlines. If there is a typing error in the name entered by the user or consumer, airlines may charge a rectification fee.
MAXIMUM STAY: a maximum of 12 months depending on the type of fare.
STOP OVER: In general, promotional and/or economic fares do not allow Stop Over (getting off the plane at a stopover between origin and destination, and staying in the city where the flight made a stopover, and then resuming the flight to the final destination). It is recommended to check which fares allow it.
CONDITIONS OF PURCHASE OF VACATION PACKAGES, HOTELS, EXCURSIONS AND OTHER SERVICES – At the moment of payment, it is declared to know and accept the terms and conditions indicated in the detail of the service, as well as the veracity of the personal data of the individualized passengers. The contracting of the service is fully completed after payment has been made and the pertinent purchase confirmation email has been issued. Some hotels and car rental companies require as a guarantee, a valid credit card with a certain amount of credit available, according to the policies of each company. NOVOTOUR is not responsible for these particular requirements of each company providing the service. For the duration of the program, the first day is considered the day of departure from the origin and the last day is considered the day of return to the destination. This applies regardless of the departure or arrival time of the flights. The so-called “courtesy” services such as: tours, insurance, breakfast, snacks, agency management commission and airfare, will not be refundable to passengers, unless an event attributable to the agency occurs that prevents the normal provision of these services.
NO SHOW: In case of no-show, passengers will be charged according to the cancellation policy established by each supplier.
ACCEPTANCE: THE CLIENT declares to accept the general contracting conditions and such acceptance is rectified by means of any of the following acts: a) Payment of the contracted services before the beginning of the trip in any way; b) Acceptance upon receipt of this contract via e-mail and acknowledgement of receipt; c) By using any portion of the contracted services. The hotel check in and check out schedule, along with the tour schedule, will be informed one week prior to your trip by means of the confirmation letter.
